There are a few
possibilities in this theory:
Bruno Heller says that we
got a glimpse of Red John's face in the season 3 finale, Strawberries and
Cream. While everyone was focusing on looking around towards the end of the
episode in the mall, I spent my time looking at the extras at the beginning and
the rest of the episode.

Then
we see this guy, who acted strangely as an extra - he was staring at the action
while walking in the other direction, and he looked back twice. He's then cut
back into the scene a few seconds later from another direction even though he'd
have been out of sight of the camera. Continuity issue, or intentional? And
does he look like the guy in the red sweater in the mall?

If Heller is using artistic license when he says that we
saw a glimpse of Red John’s face in this episode, then it’s entirely possible
that it is Bertram. Bertram called the bombing at the gas station “elegant” and
did so with a look of pride, then quickly reverted back to his CBI boss
persona. It’s a stretch, but it’s possible.
Another person to make an appearance very briefly is Oscar Ardiles who was a previous
suspect of mine, based on aspects of a psychological profile of Red John. He
would almost certainly seek work that would allow him to utilise his
manipulative side without drawing attention. As a lawyer he is able to do
precisely that, and has access to information about a ton of people. He’d also
not draw any attention to himself being in any of the law enforcement buildings
at any point. Another reason why this episode implicates him is that Rigsby made
it obvious that he was feeding information to Ardiles by pretending to let it
slip while on the balcony getting coffee. This was obvious to the viewer, and
therefore obvious to Ardiles, especially if he is Red John. He’d see straight
through this as a trap. But he still needed Hightower, hence why he sent his
assassin to the floor above and told her to climb down, therefore implicating
Bertram. Or Bertram told her himself, considering he was also told the same
information. Also, why was O’Laughlin on the roof when Van Pelt found him? Was
he simply getting coffee, or was he meeting with Ardiles – we know that Ardiles
is often there, considering that’s where Rigsby went first to feed him false
information.
